A. The duration of your claim depends very much on you:-
i. The period of your recovery.
ii. The attitude taken by your opponent on the issue of liability.
Simple claims with modest injuries should resolve within 6-9 months. However, more complicated claims tend to take longer. It is unusual for the more complicated claim to remain unresolved by 3 years.
A. It will come as no surprise to be advised that the value of a claim depends very much on the nature of the injuries sustained and the way in which the individual has been affected by the injuries.
A simple neck injury which resolves within a matter of weeks will attract compensation in the region of £1000. An accident that results in permanent injuries, restriction and pain with the victims ability to work being compromised will attract many thousands of pounds. Every case is different. We will advise you on the value of your claim once we have spoken with you.

Medical Negligence Claims – There is nothing to pay (Win or Lose) if we pursue a personal Injury claim for you. The situation is slightly different with a Medical Negligence claim as legal aid may be available. Please contact a member of our Clinical Negligence team to discuss and advise you further.
A. We will pay disbursements (money paid out) on your behalf if we issue a Personal Injury claim for you. Again the situation is slightly different with Medical Negligence claims as Legal Aid clients have the benefit of the Legal Services Commission paying disbursements on their behalf. A. In all likelihood Yes. We will have to prove that you have been injured in some way. It is usual to do so by obtaining a report from an appropriate medical expert who will want to examine you.
A. In all likelihood No. It is very unusual for claims to be referred to Court, let alone for issues of liability or value to be determined at a Court hearing we shall always prepare your case as if it were to go to Court but the chances are less than 1% that it will do so.
A. Personal Injury claims must generally be brought to the Court's attention (issue of proceedings) or settled in full by the 3rd Anniversary of an accident. If you had an accident at work or a Road Traffic Accident on 4th January 2004, you have until 3rd January 2007 in which to resolve matters or to issue proceedings.
